Partner Thomas Giordano, Jr. was recently featured in the 58th episode of Good Law | Bad Law, hosted weekly by Aaron Freiwald, Managing Partner of Freiwald Law. In this week’s podcast, Aaron interviewed Tom on topics such as the myths of Social Security disability (SSD), the differences between SSD and Supplemental Security Income (SSI), and the tax cuts to SSD included in the new health care bill.
Tom emphasized that it is a common misconception that people receiving Social Security benefits are being given a handout by the government.
“One of the most misunderstood things about Social Security disability and SSI is that we’ve paid into the Social Security system. So we’ve had 6.2% taken out of every one of our paychecks and that goes to the federal government and the Social Security trust fund, it’s not a government handout,” he said in the podcast.
Tom discussed the impact of the Affordable Care Act on disability claim cases and what would happen if efforts to repeal Obamacare are successful.
“They’re coming after Social Security, and when people think of Social Security, they don’t think of disability, they think of retirement. They’re not going to touch the retirement portion of it, but they’re certainly going to go after the disability portion of it,” he explained.
“There’s thousands if not hundreds of thousands of disabled individuals who are going to be affected by this in red and blue states,” said Tom. “Believe it or not, and this was just in The Washington Post, there are hundreds of thousands of people dying a day waiting for disability, just waiting for a chance to get benefits.”
